By accessing or using Rabble's services ("Services"), including our website at rabble.chat and our chat infrastructure API, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

2. Description of Services

Rabble provides chat infrastructure API services that enable developers to integrate real-time messaging capabilities into their applications. Our Services include API access, message delivery, rate limiting, webhooks, and message history storage based on your subscription plan.

3. Account Registration

To use our Services, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials and API keys
  • Promptly notify us of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

4. Acceptable Use

You agree not to use our Services to:

  • Violate any applicable laws or regulations
  • Transmit spam, malware, or other harmful content
  • Harass, abuse, or harm others
  • Infringe on intellectual property rights
  • Attempt to gain unauthorized access to our systems

6. Fees and Payment

Fees are non-refundable except as required by law. We may change pricing with 30 days notice.

You are responsible for ensuring you have the right to transmit Your Content and that it complies with these Terms.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We will make reasonable efforts to notify you of planned downtime in advance.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RABBLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Rabble and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

You may terminate your account at any time. We may suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason with notice. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination will survive.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "last updated" date. Your continued use of the Services after changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in Colorado.
